Understanding Copyright Ownership
In the United States, all photographs are automatically protected by copyright law the moment they are created. By default, the copyright belongs to the photographer — not the client — unless legal ownership is expressly transferred in writing.
This means that when you hire Dynamic Imagery by Travis, LLC you are purchasing a license to use the images we photograph and create, not ownership of the images themselves.
 
Copyright Ownership
Unless otherwise agreed in writing and signed by both parties, all images created by Dynamic Imagery by Travis are the exclusive property of the photographer.
No rights or ownership are transferred to you beyond the usage license outlined at the time of delivery.
 
Usage License
When images are delivered, you are granted a usage license based on the type of project:

MLS / Real Estate Sales Photography

• Images/videos are licensed for the duration of the original MLS listing and any extensions or renewals by the same listing agent or brokerage

• Images/videos may not be reused for future listings by a different agent or brokerage

• ​Images/videos are not transferable to buyers, third parties, or other agents without written permission from Dynamic Imagery by Travis LLC

• ​Images/videos may not at any point be used for vacation rental/short term rental listings, advertising the property for rent, or for any other reason outside the sole exclusive use by the listing agent during the term of the listing agreement for the property.

Vacation Rental, Commercial, & Long-Term Use

• Licensed for long-term marketing use to promote the property or business that commissioned the images

• Includes use on websites, booking platforms, social media, and print marketing

• License remains valid for the client named on the invoice, for as long as they own or manage the property.

• Images are NOT transferrable to future owners of the photographed property

Portfolio & Marketing Usage
Dynamic Imagery by Travis retains the right to use all images for:

• Portfolio showcase (website, social media, printed sample work)

• Marketing and promotional materials

• Professional publications or competitions

If you require privacy or confidentiality, please notify us in writing prior to the photoshoot. A confidentiality agreement can be arranged.

Non-Transferable Usage
License rights are non-transferable. Images may not be:

• Sold, gifted, or transferred to another party

• Used by a new property owner without permission

• Used by a different realtor/broker, property manager, contractor, rental agency, or marketing service

If ownership or management of the property changes, the new party must obtain their own license.

Summary

• Photographer retains full copyright

• Client receives a use license – not ownership

• MLS images valid only for the active listing by the original agent

• Vacation rental and commercial images licensed for long-term use by the commissioning party

• Images cannot be transferred or reused outside the agreed terms

• Photographer may use images for portfolio and marketing unless otherwise agreed in writing
